1. Who these terms apply to
These terms govern your use of arewethereyet.co.za, the Are We There Yet app at app.arewethereyet.co.za, and any related service we operate. They apply to everyone who uses the service, whether you are a parent browsing venues, a venue owner with a listing, or simply reading the site.
By using the service you agree to these terms. If you do not agree with them, please do not use the service.
Are We There Yet is operated by Are We There Yet SA, registration number 2026/733763/07. In these terms, "we", "us" and "our" mean that company. "You" means the person or business using the service.
2. What Are We There Yet is
Are We There Yet is a discovery service. We help South African parents find, view and get directions to places that welcome children, and we help family friendly venues get discovered by those parents.
We are not a booking agent, a ticketing service, a travel agent or a tour operator. We do not sell entry to venues, take reservations on their behalf, or act as an intermediary in any transaction between you and a venue. Anything you buy from a venue is a contract between you and that venue, and we are not a party to it.
The service currently includes a searchable map of listed venues across twelve categories, venue profiles with photos and details, one-tap directions, parent reviews and ratings, a paid parent subscription, and paid listing plans for venues. Some features described on our website are still in development. Where that is the case we say so plainly on the page.
3. Your account
Some parts of the service need an account. When you create one you agree to give accurate information and to keep it up to date, to keep your password confidential, and to tell us promptly if you think someone else has accessed your account.
You are responsible for everything that happens under your account. You must be 18 or older to create an account, to hold a subscription, or to submit a review. Accounts are for you and, in the case of a venue, for your business. They may not be shared, sold or transferred.
4. Venue listings
Venues submit their own listing details, including location, opening hours, description, facilities and photos. The venue is responsible for the accuracy of everything it submits, and for keeping it current. If your details change, update your listing.
Every listing is read by a person before it goes live. We aim to review new listings within 48 hours, though that is a target rather than a guarantee. We will let you know by email whether your listing is approved, needs a change, or is not a fit for the service.
We may decline, edit or remove a listing at our discretion, including where it is inaccurate, misleading, unlawful, unsafe, not genuinely family friendly, or otherwise not a fit. Where we remove a paid listing for a breach of these terms, we are not obliged to refund the balance of that period.
By submitting a listing you confirm you are authorised to act for that venue, and you grant us a non-exclusive, royalty free licence to display the text, images and other material you provide, on our website, in the app, in our newsletter and on our social media channels, for as long as your listing is live and for a reasonable period afterwards in archived material.
Registered non-profit organisations and community run venues are listed free of charge. We may ask for proof of NPO registration.
5. Reviews, ratings and the Gold badge
Reviews come from parents with accounts. When you submit one you confirm it reflects a genuine visit and your honest opinion. You may not submit a review of your own venue, of a competitor, or in exchange for payment or any other benefit.
We do not independently verify individual reviews, and we do not adopt them as our own. We may remove content that is defamatory, abusive, discriminatory, dishonest, unlawful, or that identifies a child. You keep ownership of what you write and grant us a licence to display it as part of the service.
The Gold badge is earned and is never for sale. It requires a rating of 4.7 or higher across at least ten genuine parent reviews. No plan buys it, including the most expensive one. Paying us never changes a rating and never removes a review.
6. Paid placement and sponsorship
Some venues pay for higher placement in the map, in search results, on the parent home screen, or in the Featured venues this week slot. Every piece of paid placement is labelled to parents as sponsored, wherever it appears. Paid placement affects where a venue appears. It never affects that venue's rating, its reviews, or its eligibility for the Gold badge.
7. Parent subscriptions
The parent subscription costs R49 a month and begins with a 60 day free trial. Finding venues on AreWeThereYet is free for everyone. A free parent account lets you save places and leave reviews. During the free trial you get every feature of the parent subscription.
Your subscription continues month to month until you cancel. You may cancel at any time, and you keep access until the end of the period you have paid for.
8. Venue plans
There is no free trial for venues. Venue plans work as follows:
- Get In: free. Your venue on the map with a basic profile, one photo, a short description and one-tap directions. No card required and nothing to cancel.
- Get Found: R299 a month. Everything in Get In, plus three photos, tappable contact links, your own dashboard to manage your listing, and higher placement in map and search.
- Get Noticed: R699 a month. Everything in Get Found, plus five photos, the ability to reply to parent reviews, show offers and specials to parents, and a visitor insights dashboard.
- Get Featured: R1,499 a month. Our premium plan. Everything in Get Noticed, plus nine photos, featured placement every month, one social post per month across our channels, and priority in newsletters and quarterly guides. Get Featured is limited to 18 venues per region and is not yet open for sign-up.
Prices are in South African Rand. Are We There Yet SA is not yet VAT registered. Paid plans are billed from the date you subscribe.
9. Payment and renewal
No card is needed to start the free trial. At the end of it you choose whether to subscribe and set up payment. If you do not, your account continues on the free tier with fewer features, and nothing you saved is deleted. For venue plans, Get In requires no payment ever, and paid venue plans are billed from the date you subscribe rather than after a trial. Subscriptions then renew automatically for successive periods until cancelled, and we will charge the payment method you have given us on each renewal date.
Payments are processed by PayFast by Network, our third-party payment gateway. When you pay by card, your card details are entered directly into PayFast's secure payment environment and are not provided to or stored by us. PayFast states that its systems are PCI DSS Level 1 compliant and may use security measures such as 3D Secure authentication and fraud-prevention checks. Where recurring payments are enabled, PayFast may use tokenised payment details to process future charges. We receive payment confirmations and transaction information needed to manage your account, but we do not receive or store your full card number.
If a payment fails, we may retry the payment in accordance with your subscription terms and contact you about the failed payment. If the amount remains unpaid, we may suspend or restrict the paid features of your account until the outstanding amount is settled.
We will give at least 30 days notice by email before changing the price of an existing subscription. If you do not accept a price change you may cancel before it takes effect.
10. Refunds and cooling off
The parent subscription includes a 60 day free trial, and Get In is free for venues, so in both cases you can assess much of the service before paying anything. Paid venue plans do not include a trial period.
Where the Consumer Protection Act 68 of 2008 gives you a right to cool off after an electronic transaction, that right applies and is not affected by these terms. Outside that, fees already paid for a period that has been delivered are not generally refundable, since the service is supplied continuously for the period you have paid for.
If the service materially fails to do what we said it would, contact us. We would rather sort it out directly than argue about it, and we will offer a credit, a partial refund or a plan change as appropriate.
11. Cancellation
You may cancel at any time from your account or by emailing us. Cancelling stops the next renewal. Monthly plans run to the end of the current month. Annual plans run to the end of the annual term, and the unused balance is not refunded unless the law requires it or we have failed to deliver.
When a venue listing ends, it is removed from the map and from search. Reviews already left by parents may remain in our records.
12. Visiting venues is at your own risk
This section matters, so we have written it plainly.
Venues listed on Are We There Yet are independent businesses that we do not own, operate, staff, inspect or control. A listing is not an endorsement, a safety certification, or a warranty about that venue's facilities, supervision, hygiene, equipment, staff or insurance.
Your children remain your responsibility at all times. You decide whether a venue is suitable and safe for your family. Check ages, supervision requirements, accessibility and any restrictions with the venue directly before you go, particularly for activities involving water, animals, heights or equipment.
Any complaint, injury, loss, damage or dispute arising from a visit to a venue is between you and that venue. We are happy to hear about it, and it may affect whether that venue stays listed, but we are not a party to it.
13. Accuracy of information
We make reasonable efforts to keep the service accurate, and a person reviews every listing before it goes live. Even so, opening hours change, prices change, facilities close and venues shut down. We cannot guarantee that every detail is current at the moment you read it. Please confirm anything that matters, such as hours, prices or age limits, with the venue before travelling.
Directions and map data are provided by third parties. We are not responsible for routing, traffic conditions or road safety.
14. Acceptable use
You agree not to use the service to break the law, to post content that is false, misleading, defamatory, abusive, discriminatory or harmful, to impersonate anyone, or to submit a listing for a venue you are not authorised to represent.
You also agree not to scrape, harvest, copy or systematically extract our venue data, to resell or republish our content without permission, to interfere with the security or operation of the service, or to use it to send unsolicited marketing.
Content that sexualises, endangers or identifies a child will be removed immediately and reported to the relevant authorities.
15. Intellectual property
The Are We There Yet name, logo, design, written content, database and software are ours or are licensed to us, and are protected by South African and international law. You may not copy, adapt or reuse them without our written permission.
Material you submit stays yours. You grant us the licence described in sections 4 and 5 so that we can display it as part of the service.
16. Suspension and removal
We may suspend or close an account, or remove a listing or a review, where these terms are breached, where content is unlawful or unsafe, where payment cannot be collected, or where we reasonably believe the service is being misused. Where it is practical and appropriate, we will tell you why and give you a chance to put it right.
17. Limitation of liability
We provide the service with reasonable care and skill, but we do not promise that it will be uninterrupted, error free, or that it will produce any particular number of visitors, bookings or customers for a venue.
To the fullest extent the law allows, we are not liable for indirect or consequential loss, for loss of profit, revenue, goodwill or anticipated savings, or for loss arising from your visit to, or dealings with, any listed venue.
Where we are liable, our total liability to you in any twelve month period is limited to the amount you paid us in that period. Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence, for fraud, or under the Consumer Protection Act.
18. Our charitable commitment
We commit 10% of Are We There Yet subscription revenue to charity and community initiatives. We choose a single cause each quarter, name it on our website, and publish the running total as it goes out. We will name our first cause once the first subscription revenue has been received.
This is a commitment we intend to keep and to publish openly. It does not create a legal entitlement for any person, venue or organisation to receive a payment.
19. Changes to these terms
We may update these terms as the service develops. The date at the top of this page shows when they last changed. Where a change materially affects your rights, we will tell you by email or in the app before it takes effect. Continuing to use the service after that means you accept the updated terms.
20. Governing law and contact
These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction. Nothing here affects your rights under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002.
